Matthew Belanger, an assistant arts professor, filed suit in U.S. federal court against New York University and NYU Shanghai earlier this year, alleging discrimination, but both entities argued that he has no right to sue them in U.S. courts. NYU Shanghai has asserted that it is neither a U.S. employer nor a foreign entity controlled by a U.S. employer, despite a previous claim that NYU was promised “absolute control” over NYU Shanghai operations.
